THE LAW ON SURROGACY IN GHANA: THE NEED FOR ITS REGULATION

ABSTRACT: The law that recognizes surrogacy is The Registration of Births and Deaths Act 2020, Act 1027. This law provides for the registration of births resulting from surrogacy. Prospective parents are to obtain parental orders which transfer parentage from the surrogates to them. These orders can either be a pre-birth parental order or post-birth parental order. These orders are obtained from the High Court. However, the current provision on this medical practice is not comprehensive thus it has made way for its abuse. It is imminent that a comprehensive law is enacted to govern this. The Assisted Reproductive Technologies Bill, 2021 is yet to be placed before the various stakeholders; when approved it is to regulate the activities of fertility centers and agents running such services across the country. Its regulation will protect couples, surrogates, donors, agents, health professionals, and the facilities of these services.
